Elizabeth approves four-lot subdivision with $176,534 public-improvement guarantee
Trustees approved DGH Holdings’ amended agreement for a subdivision at 350 South Elbert Street; the agreement sets an Aug. 11, 2028, deadline for public improvements but no home-buildout schedule.
The Elizabeth Board of Trustees unanimously approved an amended subdivision agreement Aug. 11, 2026, allowing DGH Holdings LLC to proceed with a four-lot residential subdivision at 350 South Elbert Street, backed by a $176,534 letter of credit for public improvements, the meeting record shows.
The agreement replaces one approved in October 2025. The previous owner, MBP Enterprises Inc., did not provide the required performance guarantee within 90 days, so the final plat was never recorded. DGH acquired the property and submitted the letter of credit, which staff described as 110% of estimated public-improvement costs.
Town documents establish four residential lots but do not specify how many homes will be built or provide a construction, phasing, buildout or occupancy schedule. During the meeting, developer Dan Henderson described the planned homes as approximately 1,600 to 1,700 square feet, without basements and with two-car garages. He estimated prices at about $425,000 to $575,000 based on current market conditions.
DGH must file a finalized, town-approved performance guarantee within 90 days after the amended agreement is executed. The available agreement does not show its execution date, so the record does not establish the exact deadline. The letter of credit must be amended to identify DGH Holdings, reference the executed agreement and remain in effect beyond the improvement deadline.
The agreement requires DGH to complete and submit the public improvements for acceptance by Aug. 11, 2028. The improvements were estimated at $160,485, including contingency, with the guarantee set at 110% of that amount. The town must record the final plat within 14 days after receiving and approving the guarantee. Accepted improvements will be subject to a two-year warranty after probationary acceptance. If the guarantee is not filed within the required 90-day period, the town may reject the plat approval.
